Domain Name
Barcelona.com was the first geographic domain name brought to Court.
Excelentisimo Barcelona City Council sued Barcelona.com for violating the Anticybersquatting Consumer Protection Act.
The conclusion is that Barcelona.com, Inc.'s use of "Barcelona" in its domain name was not unlawful under the Lanham Act, and the district court erred in applying Spanish law and ordering the transfer of the domain name to the City Council. Barcelona.com, Inc. is entitled to relief under 15 U.S.C. § 1114(2)(D)(v), and the district court's ruling was reversed.
